Dear Open Food Network users,
This is a notice that we will be updating our Terms of Service from Wednesday 24 January 2024.
You can view the updated version of the Terms of Service here.
Below is a summary of the key updates / changes that will come into effect:
-
Enterprise Users will be required to accept updated Terms of Service when they next login to their Open Food Network Account.
-
Updated and more explicit wording around the risks associated with using the Open Food Network Software Platform.
-
Improved approach to Indigenous Data Sovereignty to uphold our obligations of responsible management and sharing of Indigenous Data that may be on our Service, including addition Indigenous Data and ICIP (clause 4.3).
-
Addition of Current Third Party App Documentation to transparently display which third parties Open Food Network Australia engages to deliver our service.
-
Addition of Collection Notice of Personal Information (clause 9).
-
Addition of Data Map Summary (Attachment 3) to outline the different kinds of Content data that we hold, what is public and private and how it can be accessed and retrieved.
-
Embedded and updated Privacy Policy (Attachment 1) within the Terms of Service and better alignment of the language across both sections in relation to types of data, risks involved, how we share data.
These updates are a result of our participation in the National Farmers’ Federation Farm Data Code Audit to ensure best practices with farm data management, and engagement of Terri Janke and Company services to improve our processes and management of Indigenous Data and adhere to Indigenous Data Sovereignty principles.
Indigenous Data and Enterprise Pricing
We have not previously collected data of enterprises on the platform that are Aboriginal or Torres Strait Islander owned or led. Please contact us if you wish to identify your enterprise as Aboriginal or Torres Strait Islander owned or led. This will enable us to identify where on the platform any existing Indigenous Data is held so that we can best adhere to the Indigenous Data Sovereignty principles as outlined in the updated Terms of Service. Also a reminder of our pricing structure, we recognise that to achieve equality in Australia, we need models that address entrenched inequalities faced by Indigenous peoples. That’s why the platform is free to use for enterprises that satisfy the requirements of a Registered or Certified Indigenous Business as verified by a service provider (such as Supply Nation, Kinaway, NSWICC) or not-for-profits where more than 50% of the leadership team is Indigenous.
Thank you for being part of our community and working towards building better food systems.
Kindest,
Open Food Network Australia.
