Marshall Creek Community Development District Communications Privacy Policy

Effective: August 2024

 

The Marshall Creek Community Development District (“District”) may utilize certain electronic communication systems as a means of improving communication between the District’s Board of Supervisors and the residents and homeowners of the District.

Privacy is important to the District. The District has adopted the following privacy practices regarding what information will be collected, used, and/or disclosed when someone uses the District’s electronic communication systems, which may include the District’s website(s), mobile apps, email, instant messages, text messages, and other electronic communication systems and services (collectively, the “Electronic Communications”). Questions, concerns, or complaints regarding this Privacy Policy and the use of personal information may be addressed via e-mail to palenciaamenities@marshallcreekcdd.com.


Personal Information Usage

The District will not collect personal information from an individual using the District’s Electronic Communications (“User”) unless the User affirmatively chooses to make such information available to the District. Any personal information provided to the District may be subject to disclosure as Florida's public records law requires that all information received in connection with District business, including identifying information, be made available for inspection upon request, unless the information is confidential pursuant to state or federal law or otherwise subject to a specific statutory exemption.

If a User signs up to receive Electronic Communications, the District will collect User’s name, email address, mailing address, phone number, and any other information needed to contact User about the Electronic Communications. Please note that under Florida law, email addresses are public records and can be released in response to a public records request.

Payment information. To order products or services through the Electronic Communications, Users will need to provide the District with payment information (like your bank account or credit card information). Please note that your financial information is collected and stored by a third party payment processing company. Use and storage of that information is governed by the third party payment processor’s applicable privacy policy.

Survey information. You may provide the District with other personal information when you fill in a form, respond to our surveys or questionnaires, provide the District with feedback, participate in promotions, or use other features of the Electronic Communications. The District can use User’s personal information for the following reasons:
  • To send User notices, updates, security alerts, newsletters, support and administrative messages, or other pertinent information.
  • To reply to User’s questions, inquiries, or customer service requests.
  • To monitor and analyze trends, usage, and activities in connection with, and to improve, the District’s Electronic Communications.
  • To detect, investigate, and prevent fraudulent transactions and other illegal activities via the Electronic Communications and to protect the rights and property of the District and Users.
  • To carry out the District’s obligations arising from any contracts entered into by the District to the extent permitted by law.
  • To comply with state or federal requirements, such as compliance with a court order or law enforcement.
  • To share with vendors, consultants, and other service providers who process User’s personal information on the District’s behalf, for purposes including but not limited to data analytics, research, marketing, and financial services.
Users may unsubscribe from Electronic Communications through a link included on messages sent by the District. Users can also opt out of receiving Electronic Communications from the District at any time by emailing palenciaamenities@marshallcreekcdd.com and requesting removal from the District’s Electronic Communications and distribution lists.
 

Retention of Your Data and Deletion

The District will retain personal information to the extent permitted by law, including legal retention and destruction requirements, and as necessary for the specific purpose for which the information was collected. The foregoing will not prevent the District from retaining any personal information if it is necessary to comply with state or federal law or the District’s legal obligations including filing or defending against a legal claim or for evidential purposes.

 

International Transfers
