CDBG-DR Private Utility Alternative Requirements Memo and CDBG-DR and CDBG-MIT OMNI Notice Now Available

Under the Disaster Relief Supplemental Appropriations Act, 2022 (Public Law 117-43), HUD is authorized to publish any waiver or alternative requirement via a Federal Register notice or the Department’s website. HUD is using this authority for the first time by publishing the Community Development Block Grant Disaster Recovery (CDBG-DR) Private Utility Alternative Requirements Memo on HUD.gov on December 7, 2022. This memorandum establishes an alternative requirement for grantees with funds for major disasters occurring in 2020 and 2021 under Public Law 117-43. Specifically, this memorandum replaces the alternative requirement on private utilities at section III.G.3 of the CDBG-DR Consolidated Notice (87 FR 6388) and (87 FR 31663).

In addition, the CDBG-DR and the CDBG Mitigation (CDBG-MIT) OMNI Notice for December 2022 (87 FR 75644) was published on December 9, 2022. This notice provides waivers and establishes alternative requirements for the Commonwealth of Puerto Rico and the State of Iowa based on their requests for waivers and alternative requirements for grants provided under the public laws cited in the notice.
