Benedict located the subject’s unoccupied vehicle in the parking lot.  The PBSO Eagle and drone unit was requested.  The subject was located on the 6th floor of the observation tower in the Wellington Preserve.  Upon arrival of Deputies at the location, the subject positioned himself at the opposite side of the railing intending to jump.  For the next several hours Sgt. Benedict and D/S Bitner attempted to talk the individual.  PBSO SWAT HST was requested to assist with negotiations.  The subject requested deputies throw him a bottle of water; water bottles were tossed to intentionally land on the 2nd floor of the tower requiring the subject to come down to retrieve the bottle.  As he came down to the 5th floor, Sgt. Benedict was positioned there and attempted to gain control of the subject.  As the subject continued to pull away and try to throw himself over the railing, Sgt. Benedict, with the assistance of D/S Fuentes, was able to hold the subject down as additional deputies came to assist.  During the incident Sgt. Planning & Zoning

Estates/Lagoon at Equestrian Village:  The applicant has requested to delay the January public hearing process. They are adjusting the plan based on feedback received and are going to take time to meet with people who are now in town for the first time and further refine the plans. As this was the only item scheduled for the January Equestrian Preserve Committee meeting, the meeting is being cancelled.

Standing, Stopping, & Parking Regulations:  Based upon issues of parents waiting in the vehicles on Paddock Drive for their children from Wellington Landings Middle School, a draft ordinance is being prepared for Council’s consideration which adds “standing and stopping” to the regulations of no parking on swales. This change will clean up Wellington’s code regarding this issue and eliminate any potential enforcement issues.

Building

Inspector of The Year, President, and Director of the Building Officials Association – Palm Beach County (BOAPBC):  During the Thursday, December 15th annual meeting, the Palm Beach County Chapter of the BOAPBC awarded Sr. Inspector William Wyatt as 2022 Inspector of the Year. Chief Plans Examiner Melvin Corredor was elected and sworn in as President of BOAPBC and Building Inspector Mark Candreva was elected and sworn in as Director of BOAPBC.

13388 Polo Rd W – Unsafe Structure:  On December 8th, a Village building inspector, while on a scheduled inspection, noticed a three-story, five-unit, multi-family, condominium structure, located at 13388 Polo Rd W., with shoring/bracing installed on the rear balconies. Upon closer investigation, the inspector discovered severe spalling of the concrete on the 2nd and 3rd-floor balconies, exposing the structural reinforcing steel. This condition constitutes a serious unsafe condition. Notices of the unsafe balconies were posted on each of the condo units and notices of the condition were mailed to each unit owner and the property manager. The notices give the order to complete the repairs within 90 days of the notice. This structure is subject to the Florida-required Milestone Inspection program that was prompted by the collapse of the Surfside Condominium building.

Milestone Inspections are required by FS 553.899. Mandatory structural inspections for condominium buildings under chapter 718 and cooperatives buildings under chapter 719 that reach 30 years of age that are three stories or more are required. A total of 20 buildings in Wellington fall under this criteria. Any building with a CO issued on or before the year 1992 must have a milestone inspection done by end of the year 2024 and every 10 years thereafter. Any building with a CO issued after the year 1992 must have a milestone inspection done when the building reaches 30 of age and every 10 years thereafter. According to the date of CO of the 20 buildings mentioned above, only six would need to have their milestone inspections completed before the end of the year 2024. Milestone inspections consist of two phases, phase one is a visual inspection, and phase two consists of structural tests, an inspection report according to subsection 8 of statute 553.899, FS, of the Florida building code is required after each phase. Phase two is only necessary if the building inspector found substantial deterioration during phase one. After phase two and a report is submitted, the local building department, the board of county commissioners, and the Florida Building Commission can enforce any of the repairs recommended by the inspector.

Strategic Planning

Chickens, Peacocks, and Other Animals (Oh My!):  Based on complaints from residents regarding properties in the Equestrian Overlay Zoning District which have chickens, peacocks, and animals other than horses, staff is researching the regulations and statutes regarding farms and any potential for protecting the equestrian nature of the EOZD. Once the research is complete, the results and recommendations will be presented to the Equestrian Preserve Committee for their review.

January 9th Council Workshop:  The Treasure Coast Regional Planning Council (TCRPC) has completed Phase 2 of the State Road 7 Corridor Market Study. Phase 3 is the economic impact model of the development potential identified in Phase 2. TCRPC will be presenting the updated information from Phase 2 and the results of Phase 3 at the January Council workshop. In addition, representatives from the Spinoso Group are being invited to provide an update on the Wellington Green Mall.

Code Compliance

Wax Wing Ter Parking Compliant:  Code Compliance received a homeowner complaint concerning the neighbors parking in the street overnight and every night.  An initial inspection found no violation but follow up inspections found the violation off and on.  Homeowner reached out to Code with a picture of the parking violation and a sofa not picked up at the neighbor’s property.  Wellington code does not allow vehicles to park on the street or on the landscaped areas.   PBSO was notified and responded.  Deputy met with the Code officers and advised that he would have Citizen Patrol patrol the area often to address these parking concerns.  Public works was contacted and would remedy the situation with the sofa.
