Trash and Recycling Pickup 
Waste Connections (303-288-2100) trash and recycling pickup is still scheduled for today (Weds), but service may be later in the day than usual, depending on road conditions.
Trail Closure for Concrete Work Near Dog Park
A temporary trail closure will occur next week near the new Piney Creek Trail Extension and Dog Park in the Vistas area close to Rockinghorse Parkway and E Caleb Place.
  • The new south trailhead for the Piney Creek Trail will be poured.
  • Repairs will be made to the existing trail where there is buckled and cracked concrete (removal and replacement). 
Work is scheduled for the week of January 23-27. There is a cure time of 3-4 days before foot traffic, bicycle, or equipment can resume activity on the new concrete. The area will have signage to signal the closure and the need for caution. You may walk around the concrete work to access the trail system and dog park.
Updates to Residential Improvement Guidelines
The IMD Board approved a number of changes to the Residential Improvement Guidelines at their monthly meeting on January 10th. These changes are reflected in an updated version of the Residential Improvement Guidelines, available on the Design Review page of the website. A brief summary of the changes:
  • The number of trees required for small front yards has been reduced from two to one depending on the size of the front yard.
    • See revised Section 4.32.2 Table A for the specific details.
  • Attachment E of the Guidelines related to Artificial Turf has been updated to include guidelines related to requirements to install putting greens. 
  • Changes were made related to non-builder installed exterior lighting.
    • Soffit lighting, string lighting and up-lighting of trees can now be illuminated from dusk until 10:00 p.m. throughout the year.
    • Soffit lighting, as with all other lighting, can only be soft white or soft yellow in color and cannot have movement (no blinking or chasing lights).
    • There are exceptions allowed during the Seasonal Lighting Period of November 15 to January 15.  
    • See Sections 4.34 and 4.45 of the Guidelines for specific requirements.
Covenants in a Metro District
Definition. Restrictive covenants are deed restrictions typically found in a Declaration of Covenants, Conditions, and Restrictions. Declarations including restrictive covenants are normally drafted and put in place by the original developer. In addition to the Declaration, the Metro District adopts Rules and Regulations and Residential Improvement Guidelines that clarify the Declaration restrictions. These documents are collectively referred to as “Governing Documents.“
 
When restrictive covenants are recorded in a declaration, they bind all property owners. Even though a purchaser may not read the declaration, the purchaser is bound by the covenants because they are in his “chain of title” and attach to the property. As a result, the courts will consider each owner to have “constructive knowledge” of the restrictive covenants, meaning that an owner has knowledge of the covenants as a matter of law. What this means is that actual knowledge is irrelevant, and an “I didn’t know” defense ineffective.

Purpose of Restrictive Covenants. The stated intention of many restrictive covenants is to “preserve, protect, and enhance property values.” This goal may be achieved as follows:
Architectural and maintenance restrictions give a development a more standard appearance because they control some of the activities that take place within its boundaries. Use restrictions limit use of property for defined purposes and in accordance with defined standards. Use restrictions are generally intended to enhance the peaceful enjoyment of residents‘ use of their properties.

Types of Restrictive Covenants. 
Architectural and Building Restrictions. The covenants require an owner to seek prior approval from the Metro District’s Residential Improvement Committee before making these types of changes. Typical restrictions may include:
  • Set back requirements
  • Conditions on additions to dwellings (e.g., patios, enclosing porches, adding a second story, installing satellite dishes or solar panels)
  • Modifications to exterior appearance of dwellings (e.g., painting a different color, changing from siding to brick, adding windows and doors)
  • Exterior appearance of lots (e.g., landscaping, yard art, fencing)
Use Restrictions.  
  • Occupancy use, Leasing, Pets, Parking, Use of other limited common elements and garages (what can be stored on a patio or balcony, garage uses other than parking vehicles), Nuisance and noise, Trash, Satellite dishes, etc.
