Bail Reform Moves Ahead
Wisconsin’s bail system is broken. We are the only state that only allows judges to consider a single factor when setting cash bail – and that is whether or not someone will return to court. For the last seven years, I have been working with Rep. Cindi Duchow (R-Delafield) to give judges more flexibility when determining cash bail.
It’s common sense, if you’re a violent criminal with a violent history, you should have a higher bail. Liberal and conservative states alike allow judges to consider additional factors, like public safety (47 states, and the “primary factor” in California!) and previous criminal history (46 states). In Wisconsin, considering those factors when deciding cash bail is prohibited.
Even in the states that have “eliminated” cash bail, most actually still retain cash bail for more violent crimes. And all of the other states have a pre-trial detention system that works - Wisconsin does not.
The Legislature will vote on the proposal next week, and voters will be able to vote on the proposal on their Spring Ballot on April 4, 2023. To read the Fox 6 News article, click here.
