Federal Government Offers Year-End Gifts to Plan Sponsors    

While most of us were busy with last-minute shopping and holiday preparations, Congress worked to approve the Consolidated Appropriations Act, 2023 (CAA 2023), extending a provision that permits high deductible health plans (HDHPs) to provide first-dollar telehealth services through December 31, 2024. 

The next day, the Departments of Labor, Health and Human Services, and Treasury released FAQ 56, an important piece of guidance regarding the new prescription drug collection (RxDC) reporting. Released just four days prior to the first reporting due date, the guidance establishes transitional good faith compliance relief for plans that use a good faith, reasonable interpretation of the regulations and reporting instructions when making a submission. It also provides a 35-day grace period for submitting information, giving plans and issuers until January 31, 2023, to report their information.

These developments provide welcome relief and flexibility to group health plan sponsors.
