Recent Call Committee presents: A two-part series with Simon Borys on Parole and Corrections

Join us on February 16, 2023 (Parole) and February 23, 2023 (Corrections) from 6 to 7:30 p.m. EST.
This event is accredited for 2 substantive CPD hours.

The CLA Recent Call Committee is back with a two-part series with Simon Borys.
Simon Borys is a former police officer turned Correctional Lawyer. He regularly appears before the Parole Board of Canada and the Ontario Parole Board. He has extensive experience representing clients at all jails and prisons in Ontario in parole matters, habeas corpus applications, disciplinary court, grievances, and judicial review. Simon is also a Board Member of the Canadian Prison Law Association and Chair of the Association’s Advocacy Committee. He represents the CPLA in its interventions before the Supreme Court and the Court of Appeal.
For the parole part of the series, Mr. Borys will discuss the differences between federal and provincial parole, how to navigate scheduling your parole hearings, the criteria that your client needs to know for parole, parole suspensions for both provincial and federal, understanding strategically which cases work better for provincial versus federal parole, temporary absences, parole conditions, and parole appeals.

The first session will cover the following:
  • Different types of parole in federal and provincial
  • Parole eligibility dates in federal and provincial
  • How parole hearings get scheduled
  • How parole hearings work
  • The criteria for parole
  • Parole suspensions for both federal and provincial
  • Types of cases/clients that typically do better in provincial vs federal
  • Temporary absences
  • Parole conditions
  • Parole appeals
  • Parole considerations at sentencing
Once you register, you are registered for both sessions.
NOTE - As the dates get closer, we will provide a description for the corrections portion of the series.
  • FREE: for Student/Articling student members
  • $10 plus HST: Junior Active/Junior Observer members

Court Zoom Access

The CLA’s Criminal Law and Technology Committee knows how frustrating it can be searching for updated Zoom Court information. But we’re here to help. We’ve put together a Master List of zoom coordinates for courtrooms across Ontario, complete with Sign Up Sheet links (where used). We hope this will make finding court coordinates easier, and your mornings a little smoother. In the future, we hope these lists can be expanded to provide other helpful, jurisdiction-specific information.

Notice your courthouse is missing? Tried a link, and it’s broken? This is a work-in-progress, so if you have links, information or updates to add, please email us at modernization@criminallawyers.ca. We’d like to thank our local courthouse reps for providing this information, and the membership’s collective efforts to make this information accessible to all.

We hope this is helpful and we will continue to update and add to this resource with your contributions.

Your Criminal Law and Technology Committee Co-Chairs, Eric Neubauer & Jessyca Greenwood

Invitation to Participate in Bail Study – University of Guelph

My name is Dr. Carolyn Yule and I am an Associate Professor in the Department of Sociology and Anthropology at the University of Guelph .  I am reaching out to invite you to participate in a study that I am conducting, along with my Master’s student, Ethan McCance.  The purpose of our study is to learn more about the experiences of accused during the bail process.  In particular, we are interested in the possibility that racialized accused may face barriers to bail compared to their non-racialized counterparts.  If some racialized accused do face barriers, we are interested to learn how and why they do.  The present study aims to add to the limited scholarship on Canadian bail.

I am inviting lawyers who have at least five years of experience representing both racialized and non-racialized accused in Ontario to participate in a 45-minute virtual interview. This study has been reviewed by the Research Ethics Board for compliance with federal guidelines for research involving human participants (REB #22-10-023) and is confidential and entirely voluntary.

If you are interested in learning more about this study and/or participating in an interview, please contact us at bail@uo guelph .ca or cyule@uoguleph.ca for more information. I have also attached a recruitment poster and the consent form for more information about the study.

Thank you for considering my request!  I appreciate that you have a busy schedule and appreciate your willingness to contribute to improving our understanding of bail in Canada.

Best regards,

Carolyn Yule ( cyule@uo guelph .ca ) and Ethan McCance ( emccance@uo guelph .ca )
