Update Samenwerkingscontract BC Kimbria en Maastricht Basketbal Holding Ltd

In de afgelopen periode is door een kerngroep hard aan een samenwerkingscontract gewerkt. Deze is conform eerder afspraken aan het Bestuur opgeleverd. Het samenwerkingscontract wordt momenteel nog door juristen gecheckt. 

Leden van BC Kimbria kunnen op een drietal momenten vooraf aan de ALV van 29 maart het contract inzien:

ALV 29-03-2023

Op woensdag 29 maart (19.00 Geusselt ) vindt zoals eerder gepubliceerd de ALV plaats met als agendapunt ‘samenwerkingscontract BC Kimbria en Maastricht Basketbal Holding Ltd. 
Op Woensdag 29 maart vindt een ALV plaats waarin de groep die het contract uitgewerkt heeft het ‘samenwerkingscontract BC Kimbria en Maastricht Basketbal Holding Ltd ‘zal presenteren. Tijdens deze ALV zal een stemming plaatsvinden of de leden van BC Kimbria akkoord gaan met het samenwerkingscontract of niet.

Let op: Gezien het belang van de aankomende ALV, wijzen wij iedereen nog een keer graag op de volgende 2 artikelen uit de statuten van BC Kimbria:

Artikel 8.7: Toegang tot de algemene vergadering hebben alle leden – voorzover zij niet ten tijde van deze vergadering als lid zijn geschorst – en degene (n), die in de zin van artikel 3.16 het beroep komen toelichten. De voorzitter kan tevens toegang verlenen aan andere dan de hierboven genoemde personen.

Artikel 8.8: Leden die bij de aanvang van het boekjaar van de vereniging de leeftijd van achttien jaar hebben bereikt, brengen op de vergadering drie stemmen uit. Leden die bij de aanvang van het boekjaar van de vereniging de leeftijd van achttien jaar nog niet bereikt hebben, brengen één stem uit.

Tijdens de stemming zal dan ook een controle van lidmaatschap en leeftijd plaatsvinden. Belangrijk is om daarbij op te merken dat ouders niet stemgerechtigd zijn voor hun kinderen. 

Bij goedkeuring van het samenwerkingscontract tussen BC Kimbria en Maastricht Basketball Holding Ltd zal in de op de ALV volgende dagen bij de NBB een aanvraag voor vrije inschrijving voor de promotiedivisie, dan wel de eerste divisie ingediend worden. De NBB zal dan deze aanvraag bestuderen en eventueel goedkeuren of afwijzen. 

Afmelden en machtiging

Mocht je onverhoopt niet aanwezig kunnen zijn dan word je vriendelijk verzocht je af te melden via communicatie . Denk in dat geval wel aan de mogelijkheid een ander stemgerechtigd lid van BC Kimbria te machtigen om jou te vertegenwoordigen. 

Let op: Op basis van artikel 8.9 van de statuten mag een lid maximaal 2 machtigingen tot stemmen ontvangen.

Update Cooperation Contract BC Kimbria and Maastricht Basketball Holding Ltd

In the past period, a core group has been working hard on a cooperation contract. This has been delivered to the Board in accordance with previous agreements. The cooperation contract is currently being checked by lawyers.

Members of BC Kimbria can view the contract at three moments prior to the ALV of March 29:

- Sunday 26.03.2023 (after D1 match, approx. 18.30): Geusselt, report to Jorge Michielsen (D1 Trainer)
- Tuesday 28.03.2023 (18.00 – 21.00): Geusselt, office space in Zaal
- Wednesday 29.03.2023 (18.00 – 19.00): Geusselt, report to Bas Janssen

ALV 29-03-2023

On Wednesday, March 29 (19.00 Geusselt ), as previously published, the ALV will take place with the agenda item 'collaboration contract BC Kimbria and Maastricht Basketball Holding Ltd.
On Wednesday, March 29, a GMM will take place in which the group that has worked out the contract will present the 'collaboration contract BC Kimbria and Maastricht Basketball Holding Ltd'. During this GMM, a vote will take place whether the members of BC Kimbria agree with the cooperation contract or not.

Please note: Given the importance of the upcoming GMM, we would like to remind everyone once again of the following 2 articles from the statutes of BC Kimbria:

Article 8.7: All members have access to the general meeting – insofar as they have not been suspended as a member at the time of this meeting – and the person(s) who come to explain the appeal within the meaning of article 3.16. The chairman can also grant access to persons other than those mentioned above.

Article 8.8: Members who have reached the age of eighteen at the start of the association's financial year, cast three votes at the meeting. Members who have not yet reached the age of eighteen at the start of the association's financial year cast one vote.

Membership and age will therefore be checked during the vote. It is important to note that parents are not entitled to vote for their children.

Upon approval of the cooperation contract between BC Kimbria and Maastricht Basketball Holding Ltd, an application for free registration for the promotion division or the first division will be submitted to the NBB in the days following the GMM. The NBB will then examine this application and possibly approve or reject it.

Note: Based on article 8.9 from statutes a member may receive a maximum of 2 voting authorizations.
