Here's what happened at ADR in the first quarter of 2023
Case Title: Association for Democratic Reforms versus Union of India & ANR. | WP(c) 569/2021

Constitutional validity of the current practice of appointment of Chief Election Commissioner and Election Commissioners by Executive


A five-judge Constitution Bench comprising Justices KM Joseph, Ajay Rastogi, Aniruddha Bose, Hrishikesh Roy and CT Ravikumar in a petition filed by Association for Democratic Reforms (ADR) gave a landmark judgment directing the appointment of Members of Election Commission to be done on the advice of a committee comprising the Prime Minister, Chief Justice of India and the Leader of Opposition (or the leader of the single largest opposition party) in the Lok Sabha. This system will be in vogue till such time the Parliament passes a law in this regard.

The bench stated that there is lacuna in law relating to the appointment process of Members of Election Commission and, therefore, “any process that seeks to improve the election process before this Court must be considered”.
Supreme Court Judgment
ADR's petition challenging Finance Act,2017:

On 21-03-2023, the Electoral Bonds petition had come up for hearing before the Supreme Court.  The respondents i.e Union of India had sought more time to file a counter affidavit. The Bench comprising CJI D.Y Chandrachud and Justice Pamidighantam Sri Narsimha granted 3 weeks time to the UOI to file their counter. The Bench also directed the parties to prepare a common compilation containing the written submissions, copies of judgments and any other important material and shall be submitted a week before the date of hearing. The matter is likely to be listed for hearing on 03rd May 2023.

Letter to ECI regarding changes in Affidavits (Form 26):

On 23-03-2023 ADR along with  DAKSH and  B.PAC had written a letter to the Election Commission of India requesting the Commission to  improve and take appropriate action in affidavits (Form 26) dealing with declaration of criminal case against candidates contesting elections. In the letter , it was requested that a column on CNR No. of the case should be added in the affidavits. In addition it was also requested  that every candidate at the time of filing his nomination paper for any election to the Council of States, House of the People, Legislative Assembly of a State or the Legislative Council of a State having such a council, shall be required to furnish full and complete information in cases where cognizance was taken by the Court of competent jurisdiction as specified by the Hon’ble Supreme Court in Association for Democratic Reforms and Others vs. Union Of India and Others; (2002) 5 SCC 294 and AIR 2003 SC 2363.
