DoD Seeks Public Input on Subcontractor Payments

United States Department of Defense is seeking public input on improving the timeliness of payments to defense subcontractors. Public input is due September 12th.

The request for feedback published in the Federal Register stems from the Defense Contract Finance Study, which found that defense subcontractors and suppliers generally do not receive favorable cash flow benefits as consistently or to the same extent enjoyed by defense prime contractors. Input on this matter is sought from interested parties: including current prime contractors, subcontractors, suppliers, or vendors, and potential new entrants. This is a great opportunity for small businesses in particular to have their voice heard.

Governor Hochul Announces $150 Million New York Forward Loan Fund 2 to Provide Flexible Loans to New York State Small Businesses

Governor Kathy Hochul today announced the New York Forward Loan Fund 2 program for qualifying small businesses and nonprofits. After expanding criteria for qualifications and with even greater resources allocated for the program, the enhanced fund represents an even bolder commitment to New York State’s small businesses. Qualified recipients with fewer than 100 employees and less than $5 million in gross annual revenue can apply for loans up to $150,000 with affordable, fixed-rate interest rates. Part of New York’s broader State Small Business Credit Initiative efforts led by Empire State Development, the fund will be in place for the next eight years and will focus on helping small businesses and nonprofits, particularly those in low-income and historically underbanked communities and rural areas access flexible working capital to cover a wide range of expenses, from payroll and marketing to facility renovations. Additionally, free support services from experts will work with businesses throughout the life of the loan.

Clarity Is Key: An Example of Why Clear Language Is Important for Showing SDVOSB Control 

To qualify as a service-disabled veteran-owned small business, a company must be unconditionally controlled by one or more service-disabled veterans. Establishing that control to the satisfaction of the U.S. Small Business Administration – which now administers the SDVOSB program government-wide – may require a contractor to amend its governing documents (such as its operating agreement or bylaws), as well as meeting minutes to reflect the required level of control. A recent decision by the SBA’s Office of Hearings and Appeals upholding the denial of an SDVOSB application demonstrates the importance of paperwork clarity for SDVOSBs. A recent joint initiative between the SBA and the General Services Administration aims to increase federal contracting opportunities for certified small disadvantaged businesses in the SBA’s 8(a) Business Development Program. Through the joint initiative, the SBA and GSA intend to boost 8(a) awards under the GSA’s Multiple Award Schedule program, commonly known as the GSA Schedule. Read more about the initiative here.
