City of Kalamunda advertises tree retention Local Planning Policy

The City of Kalamunda has prepared draft LPP33 - Tree Retention to minimise removal of trees on private property and within road reserves through the planning and development process. Policy measures include the requirement to plant one tree per 350sqm lot area for single houses and grouped dwellings and an offset of two trees planted for every tree worthy of retention removed. The City is currently seeking comment on the draft policy

Feedback sought: application of tree requirement provisions of R-Codes

How are you implementing cl. 5.3.2 C2.2 of R-Codes Vol.1? In particular how is the requirement for a minimum tree planting area to be shown on plans being enforced at building permit stage? Please let us know your approach to this matter. 

News: planning policies to consider embodied carbon in New South Wales

NSW has just announced it will amend its State Environmental Planning Policy to introduce embodied carbon as a planning consideration. NABERS is developing a rating tool to support the policy that will apply nationally.

This recent Minter Ellison article summarises key considerations of the Community Titles Act 2018 and application of community schemes from a proponent's perspective, including planning requirements and timelines. 

Feedback sought: calculating car parking cash in lieu with land value

DPLH are seeking feedback on a proposed alternative calculation for cash in lieu car parking payments to include land value, and for Local Governments to indicate scenarios where the calculation method could apply. Read more

Update: draft State Planning Policy 2.9 - Planning for Water and Guidelines

These are now 'seriously entertained' documents to be considered when commencing reviews of planning strategies, schemes, policies etc. Our draft submission is currently being considered by WALGA State Council. 

Update: SPP Guidelines

In 2019 WALGA contacted the Minister regarding the lack of formal process and consultation for SPP Guidelines reviews. DPLH is currently developing a document to govern the review of Guidelines, including consultation requirements. 

Building Updates

Building and Energy update

Slides presented by Building and Energy in May 2021 on bushfire and residential energy efficiency requirements in Western Australia are now available. This includes an overview of changes to bushfire requirements in the Building Regulations 2012 and changes to BA3 & BA18. 

General inspections for balustrading

Building and Energy is carrying out a general inspection to assess how building standards are being applied through the approval process, procurement and manufacture of balustrade products. Building and Energy will shortly contact those who may assist with the audit. 

Updates to BA20 and BA20A forms

New versions of the BA20 and BA20A forms have been approved and published by Building and Energy in response to industry requests for clarity over instances where consent or a court order is not required for the removal of fences. Access the updated forms here

Shire of Murray Yunderup field tour

Hosted by Shire of Murray, the October Local Government Coastal Hazard Risk Management and Adaptation Planning (CHRMAP) Forum included presentations from the Shire, Baird Australia and the Town of Port Hedland, and a field trip to the Murray Delta Islands (pictured).

Claire Lings has been with us since late 2020 and brings 25 years experience as a metro and regional building surveyor. Current projects include responding to proposed building reforms, the ABCB's consultation on energy efficiency and progressing ESD outcomes for WA. 

Local Government building surveyors working groups - October meetings

Attendees discussed the current draft WA Building Surveyor Code of Conduct and the consultation submission being completed by WALGA, as well as emerging issues for the sector. Contact Claire Lings to get involved.

Did you know WALGA offers courses on urban planning? The courses provide insight into the planning framework and decision-making process, and are suited to early-career planners, officers from related disciplines (e.g. building) as well as management and Elected Members.
